Domain Services Terms and Conditions

Basic provisions

  1. These Terms and Conditions for WEDOS Domain Services (hereinafter referred to as the "DS Terms") are part of the "General Terms and Conditions for Services Provided by WEDOS, Internet a.s." (hereinafter referred to as the "GTC").
  2. The use of these DS Terms and Conditions takes precedence over the use of the GTC.
  3. These DS Terms and Conditions govern the registration, re-registration, renewal, and changes to domain names maintained by the Operator, as well as the WHOIS Domain Privacy Protection service.
  4. A registry is an organization that is responsible for the administration and operation of a particular top-level domain (TLD). The term registry also refers to the registry backend.
  5. If the Customer registers and manages domains on behalf of a third party (domain holder), they are obliged to obtain the consent of this third party to these DS Terms and Conditions and any terms and conditions of the relevant domain registry. Upon request, they are obliged to provide proof of this consent, otherwise the domain name may be canceled without compensation.
  6. The domain holder agrees that their personal data may be transferred to other persons if this is necessary for the management of the relevant domain, and that their personal data must be published in the relevant registry information systems (in WHOIS systems).
  7. The customer leases the domain name for use from the relevant registry, to which fees are paid for the lease of the domain. The operator is the technical administrator of the domain, not its owner or payer.
  8. Both the customer and the domain holder agree to the rules of the relevant registry and the rules of the relevant TLD.
  9. The Customer is obliged to ensure that the domain contains correct and up-to-date information about the domain holder and other contacts and other information as required by the relevant registry. Otherwise, the Customer runs the risk that the domain will be canceled due to incorrect information without any entitlement to compensation for financial losses or damages caused.
  10. The operator is entitled to communicate directly with the domain holder if necessary.
  11. In the event of a request from the domain holder, the Operator may remove the domain from the Customer's account and place it under the direct administration of the holder. In such a case, the Customer is not entitled to a refund of any fees for the unused period of the domain.
  12. The Operator offers various additional services for domains. An overview of these additional services is always provided in the current price list for domain names or related documents. The Operator is entitled to change the price of additional services at any time with immediate effect. 
  13. The Operator is entitled to change the price for registration, renewal, re-registration, or other similar operations with domain names from the following prepaid period, i.e., from the moment of the next service renewal. 

Domain registration

  1. The ordered domain will be submitted for registration only after payment of the relevant fees according to the current price list and fulfillment of any additional conditions required by the Operator or the relevant registry for the given TLD.
  2. Placing or paying for a registration order does not entitle the Customer to the domain name in question. This entitlement arises only after the registration has actually been completed and confirmed by the Operator.
  3. The customer understands that the Operator may require the domain holder to provide additional documents or other requirements necessary to register the domain, in accordance with the conditions set by the relevant registry for the specific TLD. This may include personal data (birth number, ID card number, date of birth), the delivery of an officially certified document, the sending of a copy of a personal document, consent to additional conditions, etc.
  4. Domain registration will only be carried out if:
    – the relevant registry allows the registration of the given domain name
    – the domain name is freely available for registration at the time of domain registration, the name is not blocked in any way, reserved, or prohibited
    – the applicant for domain registration has met all the conditions set by the relevant registry
    – the relevant registry is fully functional and successfully confirms the domain registration
  5. The domain name that the Customer wishes to register cannot be reserved or blocked in any way by completing the order. If another party interested in registering the same domain name fulfills all the requirements for registration first, the domain cannot be registered for the Customer.
  6. The operator is not liable for any damages caused by the inability to register a domain.
  7. If the conditions for domain registration are not met, the order will be canceled after 30 days and any fees already paid will be refunded to the customer, if the status of the order allows it.
  8. The Operator does not check or verify the legitimacy of the Customer's request to register a given domain name, nor does it bear any legal responsibility for it. The Customer is responsible for any problems or damages caused by conflicts with trademarks, court decisions, or other obstacles that prevent the Customer from using the domain name.
  9. Similarly, the Operator does not check whether all non-technical requirements for domain name registration are met, in particular compliance with various rules (e.g., additional individual registry rules for a given TLD). In the event of non-compliance, the domain name may be canceled without compensation. 

Domain expiration and renewal

  1. The customer is obliged to pay the fees in a timely manner and fulfill any other requirements for extending the validity of the domain for another period.
  2. If the customer fails to fulfill all requirements (in particular, payment of fees for the next period and acceptance of the rules) for domain renewal more than 14 days before its expiration, the customer and domain holder are at risk of having the domain canceled.  The customer also acknowledges that if the domain is not renewed, the original content may become unavailable after expiration for some TLDs. 
  3. The Customer is obliged to monitor and keep track of the expiration dates of their domains. The Operator shall inform the Customer of an impending expiration, but is not obliged to do so. The Operator is not liable for any damage caused by the Customer not receiving a notification of domain expiration.
  4. The domain will be renewed for another period only if:
    – the customer has fulfilled all the requirements for domain renewal well in advance of its expiration
    – the relevant registry allows domain renewal
    – the relevant registry is fully functional and successfully confirms the domain renewal
    – the domain has not been canceled due to failure to renew it in time
  5. If the Customer fails to respond to the domain expiration notification, the Operator is entitled, but not obligated, to inform the domain holder directly.

Domain re-registration

  1. The ordered domain re-registration will only be carried out if the Customer and the domain holder meet all the requirements set by the Operator or the relevant registry for the given TLD. For some TLDs, re-registration requires the payment of an administrative fee, a fee for the operation of the domain for the next period, the entry of authorization information, or the approval of the transfer in another manner.
  2. Domain re-registration will only be performed if:
    – the relevant registry allows re-registration of the domain name in question, and re-registration of the domain or changes to the domain are not restricted or blocked in any way
    – the applicant for domain registration has fulfilled all the conditions set by the relevant registry
    – the relevant registry is fully functional and successfully confirms the re-registration of the domain
  3. The operator is not liable for any damages caused by the inability to re-register the domain.
  4. If the conditions for domain re-registration are not met, the order will be canceled after 30 days and any fees already paid will be refunded to the customer, if the status of the order allows it.

Changes to the domain

  1. All changes to the domain must be correctly authorized by the Customer, i.e., the Customer must provide the relevant login details. 
  2. The operator may require additional authorization (e.g., via email, SMS, or by sending documentation) for certain changes.
  3. Any changes to domains may be charged by the Operator according to the current price list or by agreement between the Customer and the Operator.
  4. The domain change process will only commence after payment of any applicable fees and fulfillment of any other requirements specified by the Operator or registry for the given TLD.
  5. Changes to the domain can only be made if the domain status allows it and the registry permits such a change.

Canceling domain requests

  1. Cancellation of a request means a request by the Customer or domain holder to cancel or suspend an ongoing registration, re-registration, renewal, or other change to a domain.
  2. If the situation allows, such a process may be stopped. The Operator may charge a fee for the customer's request to cancel the request according to the current price list.
  3. If the action cannot be reversed, the Customer cannot claim a refund of the fees associated with the request.
  4. It is not possible to cancel changes to domains once they have been made. In such cases, the Customer is required to request a change to the original data or status and pay any fees associated with such a change again.
  5. The domain registration or renewal process does not allow for refunds for already registered domains, and the customer understands and agrees that the registration or renewal of a domain is not subject to the legal conditions for withdrawal from a distance contract (contracts concluded with consumers at a distance in accordance with the relevant legal regulations). The customer therefore cannot withdraw from the domain registration contract if the domain registration was carried out before the expiry of the period for withdrawal from the contract by the consumer in accordance with a special legal regulation.

Operation and use of the domain

  1. The customer is fully responsible for how their domains are used and what websites and other services are operated on them.
  2. In the event of a legal (or other similar) dispute concerning the domain, the Operator may, on the basis of a court order or decision (of a similar nature), prevent the Customer from using the domain or make the ordered changes. In the event of an ordered change of ownership to another party, the Customer shall not be entitled to a refund of any fees for the unused period of the domain's validity. Similarly, the Customer shall not be entitled to compensation for any damages caused by the restriction of domain use or ordered changes to the domain.

DNS

  1. The customer is responsible for correctly setting up DNS records on authoritative DNS servers for the given domain.
  2. The Operator offers free placement of DNS records for domains on its DNS servers for domains that are registered with the Operator (as a registrar) and also use other services offered by the Operator (such as web hosting or virtual or dedicated servers).
  3. The Operator is not liable for any problems caused by a malfunction or unavailability of the Operator's DNS system.
  4. The Operator is entitled to delete a domain from the DNS system if the domain does not use the Operator's DNS servers for a period of 60 days.
  5. The Operator offers the use of DNSSEC technology only for domains for which it is the registrar, and only in the following two variants:
    – the domain uses the Operator's DNS servers, records are signed with the Operator's DNSSEC keys, the Customer cannot use their own key
    – the domain does not use the Operator's DNS servers, the Customer must use their own DNSSEC keys
  6. The operator is not liable for any problems caused by incorrect settings or technical malfunctions of DNSSEC technology.

WHOIS Domain Privacy Protection

  1. The Customer is entitled to order the WHOIS Domain Privacy Protection service for their domain name, which allows the Customer's registration data to be hidden from the public. The extent to which individual data is hidden varies depending on the options offered and the selected service option. 
  2. The WHOIS Domain Privacy Protection service is charged according to the current price list. The options offered are described in their current form on the Operator's website.
  3. The operator is not liable for any problems caused by concealing data from third parties.
  4. The operator offers this service only for certain domain extensions (TLDs) in accordance with the rules of the relevant domain registry. In the event of changes to the domain registry rules that make it impossible to use the WHOIS Domain Privacy Protection service, the customer will be immediately informed of this fact, including the procedure (plan) for canceling the service. In this case, the customer will be refunded the amount for the unused period (rounded to whole months).
  5. The WHOIS Domain Privacy Protection service is offered as an additional service for domain names and can be activated at any time. This additional service can be activated immediately when ordering a new domain or re-registering an existing domain with the Operator or for an existing domain that is managed by the Operator (and where the Operator is the registrar). 

Customer support

  1. Customer support for domains is provided only through the community forum or, in urgent cases, through tickets from Customer Administration, on business days between 8:00 a.m. and 4:00 p.m. CET (GMT +1). Outside these hours, we cannot guarantee the proper renewal of domains or the resolution of administrative or technical issues with domains, even those that may or do have a direct impact on the functionality of the domain.
  2. It is possible to purchase other types of support for domains according to the current offer provided by the Operator. 

Duration of the agreement and its termination

  1. The Agreement is concluded for a fixed term of at least 1 year and a maximum of 10 years. The specific duration of the Contract is determined by a written agreement between the contracting parties or automatically by the Customer's choice of billing period when ordering the service, in which case the duration of the Contract is automatically agreed to be the same as the duration of one billing cycle.
  2. Based on a request with an officially certified signature, which the Customer delivers to the Provider in writing, the Operator will delete the domain. Deleting the domain does not give rise to any claim for a refund of the amount already paid (not even a proportional part).
  3. Deleting domains in accordance with the previous paragraph is subject to a fee according to the current price list.
